There is no fixed formula. Pain and suffering covers the physical pain and emotional toll of your injury, and in California it is left to the judgment of a jury or the negotiation between your attorney and the insurance company, based on the specific facts of your case.

These are called non-economic damages. Unlike medical bills or lost wages, they do not come with a receipt, so how you prove them matters a lot. Adjusters sometimes point to a rough multiple of your medical costs, or a per-day figure, but those are starting points, not rules. What actually moves the number is how badly the injury disrupted your life. A serious back injury or neck injury that keeps you from working, sleeping, or picking up your kids carries far more weight than a strain that heals in a few weeks.

We build the picture with your medical records, your doctors, and often the people who know you, so it is clear how the injury changed your daily routine and how long it may last. Future pain and the cost of future care can factor in too.

Keep in mind California is a pure comparative-fault state, so if you are found partly at fault, your recovery is reduced by that share. This is general information, not legal advice, and every case is different.
