Usually, no. The first offer from an insurance company is often lower than what your claim may actually be worth, and once you sign a release, you generally cannot go back for more.
Here is the problem. Adjusters often make a quick offer before you know the full extent of your injuries. If you have a back injury or a neck injury that needs months of treatment, or future medical care down the road, an early check will not cover what comes next. Your damages can include medical bills, lost wages, pain and suffering, and future care, and you only get to settle once.
There are a few California specifics worth knowing. You generally have two years to file a personal injury lawsuit under Code of Civil Procedure section 335.1, but claims against a public entity can have much shorter deadlines, sometimes just a few months. California is also a pure comparative fault state, so if you were partly at fault, that reduces your recovery but does not erase it. Adjusters sometimes lean on that to justify a low number.
Before you accept anything, it helps to understand what your case may be worth. Whether it started with a car accident or a slip and fall, a free look at your personal injury claim costs you nothing.
